BACKGROUND/HISTORY
The purpose of this policy is to ensure that students, faculty and staff experience a healthy, safe and productive environment that is smoke/tobacco free and is in compliance with both the Arkansas Clean Indoor Air Act of 2006 and the Clean Air on Campus Act of 2009.
SCOPE
This policy applies to all faculty, staff, students and campus visitors on and within all campus property and vehicles, owned or leased.
AUTHORITY
The Arkansas Clean Indoor Air Act of 2006, Promulgated Under the Authority of Act 96 of 1913, As Amended by Act 990 of 1991 (Ark. Code Ann. § 20-7-109(a)(1)) and Act 8 of the First Extraordinary Session of 2006 (Ark. Code Ann. § 20-27-1801-1809). The Clean Air on Campus Act of 2009 (Ark. Code Ann. §6-60-801-807)
DEFINITIONS
Banned Smoking or Tobacco Products include but are not limited to: cigarettes, cigars, pipe tobacco, smokeless tobacco products, electronic cigarettes and electronic vaping devices.
Contracted Worker: Anyone employed by a third party to complete work projects or provide services on the NPC campus (e.g., construction worker, security guard, consultant, etc.).
POLICY STATEMENT
Use of banned products identified above is not permitted on the NPC campus or NPC off-campus sites by students, faculty, staff, contract workers and visitors. Violators of this policy will be referred to Human Resources or Student Affairs for College disciplinary actions. In accordance with ACA §6-60-807 (2015), a fine of not less than $100 and no more than $500 could be imposed by local law enforcement.
RESPONSIBILITIES
College faculty, staff and students should consult their respective handbooks regarding specific procedures regarding this policy.
Visitors and Contracted workers must abide by Arkansas law while on campus.
